The
importance of the ‘fairness’ of relationships between debt collectors and their
customers hasbeen at the centre of recent consumer credit reform, with such
ideas and policies as ‘Treating Customers Fairly’ becoming critical to
companies compliance regimes. To treat a customer fairly within any relationship
it is important to both have all the information that there is on a customer
and to make sure that the information is correct.
The British
government has shown much commitment to dealing with the behaviour of
businesses and the treatment of customers, through changing policy. However,
still it is important for the customer in the case of debt collections to be
reminded of their responsibilities to
their debts.
Rules and Regulations which need to be considered with regards to
treating customers fairly–
·
Unfair Contract Terms Act 197
·
unfair terms in Consumer Contracts Regulations 1999
·
consumer protection from Unfair Trading Regulations 2008
·
FSA Treating Customers Fairly initiative (TCF)
·
the ‘Unfair Relationships’ provisions under the Consumer Credit Act
1974
