Trace, Social Media and the Data Protection Act

Personal information gathered from social media must be treated in the same way as any data, as set out in the data protection act. However, there is a twist as social network users often only confirm default data access settings without giving any thought to the implications of this.

Therefore, if there is any doubt as to whether the information collected from these data sources has been collected without the users expressed permission further investigation is required. The ICO suggests that the person who’s information that is being collected should be contacted first to give permission. Does this therefore mean that a trace could become invalid if social media is used to locate a debtor?
